Atty. Randolph Libayan of the social media channel ‘Batas Natin’ talked about the possible rights of Francesca Rait to the properties left by Francis Magalona if ever she proved her paternity.
During one of the episodes of his online show, Libayan answered some of the inquiries of his followers, who were curious if Francesca would ever have a chance to get a piece of her alleged father’s estate.
Libayan said that if Francesca proved her paternity, a part of Francis’ inheritance would be automatically hers.
“Kunwari kung sa’yo ay 15 percent, lahat ng ari-arian ni Francis M, mayroon kang 15 percent… Meron siyang karapatan,” said Libayan.
The lawyer also said that Francesca would still get some of the inheritance from Francis’ estate even if it were already distributed to his other children.
“Kasi nga magiging invalid ‘yung transfer because there’s no valid transfer if you have no rights to transfer the particular property, ano ang ibig ko sabihin dito, ibig sabihin niyan kunwari dalawa kayong anak, wala na kayong magulang namatay pareho, 50-50 kayo ‘yung isang lalake dahil siya ay gahaman ang isa niyang kapatid hindi mo alam na may property pa pala na naiwan ‘yung mga magulang niyo, ang ginawa niya in-approriate niya lang sa sarili niya, ang ginawa niya siya ay ni-transfer niya, gumawa siya ng declaration of sole heir sinabi niya na ‘ako lang ‘yung anak wala ng iba’. Tapos ni-transfer niya ‘yung mga properties sa kanya illegal ‘yon” he said.
It can be recalled that Abegail Rait said that they didn’t receive any properties after Francis’ passing, and she raised their daughter alone.
It’s not yet known if Abegail would try to prove the paternity of her daughter via a DNA test.
