One of the cases filed by actor Sandro Muhlach against two former independent contractors of GMA Network was junked by the Pasay City Metropolitan Trial Court (MTC).
The said charge was the acts of lasciviousness case filed by Sandro to Jojo Nones and Richard Cruz, who allegedly took advantage of him in a hotel room last year.
According to the ruling by Pasay MTC Branch 46, Nones and Cruz’s motion was granted to quash the charges, saying that the allegations were already covered by other complaints filed by the Department of Justice (DOJ).
“The acts of lasciviousness before this court are necessarily included in the charge of r-pe before the Regional Trial Court,” the court ruling read.
It can be recalled that Jojo and Richard denied the allegations against them.
However, CCTV footage outside the hotel room showed how Sandro’s gesture changed before and after he visited the suspects.
“Noong nagpunta siya doon sa hotel na naka-check in ang dalawang subjects, normal at relaxed ang movement ni Sandro pero after noong nangyari ‘yung insidente, makikitang nagbago ‘yung kaniyang kilos. Siya ay mabilis ng maglakad, balisa at parang distressed and very anxious,” NBI investigador Atty. Zulikah Marie Conales said.
“Bigla na lang siyang umupo sa tabi ng wall fronting the elevator kung saan inaantay niya ‘yung mga kaibigan niya na sumundo sa kanya,” she added.
