Isang abogado, ipinalala na nasa batas ang obligasyon ng anak na tulungan ang magulang

A lawyer shared a reminder to his followers amid the feud between two-time Olympic gold medalist Carlos Yulo and his mother, Angelica Yulo.

In his social media post, Atty. Mel Sta. Maria reminded that children are obliged under the law to support their parents when necessary.

The lawyer mentioned Article 195 of the Family Code, which indicates that family members should support each other.

 

“Linawin natin, ayon sa batas, may obligasyon ang isang anak suportahan ang kanyang magulang kung nangangailangan ang magulang. Kasama sa suporta ang sustenance,dwelling,clothing, at medical attendancem,” he said.

He also said that the amount a child should be given as support to his/her parents must only be enough for their basic needs.

“MAGKANO po ang halaga ng suporta sa magulang? Ang amount ng support ay ayon sa pangangailangan ng susuportahan at sa kakayahan ng nagsusuporta. Binabalanse ang dalawang iyan. HINDI po layon ng support ang payamanin ang sinusuportahan. Halimbawa may resources na P10 million ang anak, hindi naman P1 million bawat buwan ang ibibigay sa magulang. Ayon lamang sa tamang need ng parents na makakapagdulot na maayos na pamumuhay. Tandaan ang elements: Need of the recipient and the Capacity of the giver. If one is absent, no support is required,” he stated.

The lawyer said that regardless of his relationship with his mother, he would never hesitate to help her.

“If my mother is in need of help and support, I will give that support kahit ano pa ang past namin, good or bad, sa abot ng aking makakaya at ayon sa kanyang pangangailangan. Iyan lang po ang akin,” he said.
